1. Introduction

1.1 These Terms & Conditions (“Terms”) govern your use of the website and services provided by HCP Auctions (South West) Ltd (“HCP Auctions”, “we”, “us”, “our”).
1.2 By creating an account, placing a bid, listing an item, or using the “Buy It Now” feature, you agree to be bound by these Terms.
1.3 If you do not agree to these Terms, you must not use our website or services.

2. Definitions

  • “Site” means the HCP Auctions online platform.
  • “User” means any person who accesses the Site, including buyers and sellers.
  • “Seller” means a User listing items for sale.
  • “Buyer” means a User bidding on or purchasing items.
  • “Auction” means a time-limited sale where Users place bids.
  • “Buy It Now” means a fixed-price purchase option available on some listings.

3. Eligibility

3.1 You must be at least 18 years old to use the Site.
3.2 You must have legal capacity to enter into binding contracts.
3.3 You must ensure your registration details are accurate and kept up to date.

4. Account Registration and Security

4.1 You are responsible for maintaining the confidentiality of your account login details.
4.2 You are responsible for all activity conducted through your account.
4.3 We reserve the right to suspend or close accounts where we suspect misuse, fraud, or breach of these Terms.

5. Role of HCP Auctions

5.1 HCP Auctions acts as a facilitator of transactions between Buyers and Sellers.
5.2 Unless expressly stated otherwise, HCP Auctions is not the seller of items listed on the Site.
5.3 We do not guarantee the accuracy of listings, nor the quality, safety, legality, or authenticity of items.
5.4 Transactions take place directly between Buyers and Sellers.

6. Listing Items

6.1 Sellers must ensure that all item descriptions, photographs, pricing, and conditions are accurate and not misleading.
6.2 Sellers must ensure they have the legal right and authority to sell the items listed.
6.3 Items must not breach any UK laws, including those relating to prohibited or restricted goods.
6.4 HCP Auctions may edit, refuse, or remove listings that violate these Terms or applicable law.

7. Bidding Rules

7.1 Placing a bid constitutes a legally binding offer to purchase the item if you are the winning bidder.
7.2 Bids cannot be withdrawn unless permitted by law or by HCP Auctions in exceptional circumstances.
7.3 The highest valid bid at the end of the auction period wins.
7.4 Sellers may set a reserve price; if not met, the item is not sold.

8. “Buy It Now” Purchases

8.1 Selecting “Buy It Now” creates a binding contract of sale at the listed fixed price.
8.2 Buyers must ensure they have the ability to complete the payment before committing.
8.3 Sellers must honour any valid “Buy It Now” purchase.

9. Payment

9.1 Payments are processed through our approved payment partners.
9.2 Buyers must make payment promptly after winning an auction or using “Buy It Now.”
9.3 Sellers will receive payment once the Buyer has completed the transaction in accordance with the payment process.
9.4 Fees, if any, will be clearly displayed before listing or purchase.

10. Shipping, Collection & Delivery

10.1 Responsibilities for shipping, collection, or delivery will be stated in each listing.
10.2 Unless stated otherwise:

  • Sellers are responsible for dispatching items within a reasonable timeframe once payment is received.
  • Buyers are responsible for providing accurate delivery information.
    10.3 Risk passes to the Buyer upon delivery or collection, depending on the agreed method.

11. Returns, Cancellations & Consumer Rights

11.1 Consumer rights differ depending on whether the Seller is a business or a private individual.
11.2 Where the Seller is a business seller, Buyers may have statutory rights under the Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013, including potential cancellation rights.
11.3 Where the Seller is a private individual, consumer legislation on returns may not apply; however, Sellers must not misdescribe items.
11.4 All refunds, returns, and disputes are handled directly between the Buyer and Seller unless HCP Auctions chooses to intervene at its discretion.

12. Prohibited Activities

Users must not:

  • Use the Site for unlawful purposes;
  • Provide false or misleading information;
  • Interfere with auctions or manipulate bidding;
  • Copy or misuse content from the Site;
  • Circumvent fees or security measures.

13. Fees

13.1 Any applicable buyer or seller fees will be displayed clearly before listing or purchasing.
13.2 Fees may be updated from time to time. Continued use of the Site constitutes acceptance of any updated fees.

14. Limitation of Liability

14.1 Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any matter that cannot legally be excluded under UK law.
14.2 To the fullest extent permitted by law, HCP Auctions is not liable for:

  • Losses arising from transactions between Buyers and Sellers;
  • Loss of profits, data, goodwill, or consequential losses;
  • Errors in listings or unavailability of the Site.
    14.3 Our total liability to any User for any claim arising out of or relating to the Site is limited to the total fees paid by that User in the preceding 12 months.

15. Intellectual Property

15.1 All content on the Site (excluding user-generated listings) is owned by or licensed to HCP Auctions.
15.2 Users may not copy, distribute, or exploit Site content without permission.

16. Privacy & Data Protection

16.1 Personal data is handled in accordance with UK GDPR and the Data Protection Act 2018.
16.2 Details of how we process data are provided in our Privacy Policy.

17. Suspension & Termination

17.1 We may suspend or terminate access to the Site where a User breaches these Terms or where required by law.
17.2 Users may close their accounts at any time.

18. Disputes

18.1 Disputes between Buyers and Sellers should be resolved directly by the parties.
18.2 We may, but are not obliged to, assist in resolving disputes.
18.3 These Terms are governed by the laws of England and Wales.
18.4 Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

19. Changes to These Terms

19.1 HCP Auctions may update these Terms at any time.
19.2 Significant changes will be notified on the Site.
19.3 Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
